No more temporary fencing!! Woo hoo!


Well after months and months we can finally take a photo of the finished outside of our home without temporary fencing in front of it. Will be good when that green bin goes, but it's handy, so I want it to stay a while longer!

    Nice to see that the trials and tribulations of your build seem to have mirrored ours!

    I found you via a post you made on the homeone forums where you said; "...it does not matter at all if you don't want the fence built yet. If your neighbour does, they have a right to have it." Do you have any references for that? We're in that exact position. Our neighbours (who are now up to frame stage) don't want the fence yet. They originally said they were worried about site access. We offered to pay any fees incurred for that. They still say they don't want the fence. We have three kids and are living surrounded by mud and tradies' dogs. If we offer to pay for the whole fence now (and recoup it from them later) can they still refuse to have one built?

    You have the law on your side on this. You can google Fencing Act Victoria and it will reiterate this- if you need animals,kids etc secured you have the right to build a fence whenever you like to ensure the safety/wellbeing of your property and family. It is unreasonable to expect you hold off because that makes it easier for your neighbour. It is their responsibility to wear any additional site costs that result from their access being changed. After all, access via your property is a privilege it's not their right.
    Your fencer should now send them a 'Notice to Fence' (saying it's going ahead and detailing their half of the cost) and if the neighbour doesn't pay the fencing company, they will chase their half of the money up for you. That way you won't be out of pocket and don't have to worry about chasing up funds while trying to maintain a civil relationship with the neighbours. Hope that helps!
